The EEOC* received 99,022 complaints in FY2010, the highest number of discrimination and harassment complaints in its 45-year history. In the same time period, the EEOC recovered a record $404 million from employers, a figure that excludes the judgments from any of the 250 new lawsuits filed during the year. The Department of Justice and the SEC are stepping up enforcement efforts for corruption violations. Want proof? In the first half of 2010, the agencies collected $1.5 billion in fines and penalties. Prior to the 2010 campaign, recoveries totaled only $3 billion since the FCPA was enacted in 1977! Notable case: Siemens agreed to a $1.6 billion settlement for numerous violations in 2008. The company had an anti-corruption program in place, but because it failed to train employees, the SEC argued it was merely a “paper program” and not effective.
